He cannot issue a refund. the only person who can do that is Envato themselves. You need to contact support http://support.envato.com/ and ask for a refund explaining your problems.

Please be aware they will need to test the theme to see if it is actually broken as a lack of experience is not grounds for a refund.

Maybe with some work. There are a lot in this style so it will need to have some more unique features.

Typography needs a lot of work, and a bit around alignment, spacing and not sure the Twitter feeds in the footer work in that layout

With all due respect I do not think you will get it through in PSD – the design is outdated and simple, typography and spacing needs work and there is nothing original about. Also avoid using leading brand logos in your designs.

You may have more luck coding it but it will still require some work and modernisation

That is a site template NOT a Wordpress theme – it will not work on Wordpress

Not sure about the search box below the logo and the typography alignment could be better.

Most of all it is way too basic for PSD and too many other items like it. You will do much better to go straight to code with it
