Am I allowed to giveaway 1 copy of the theme for charity/school?
Regular licence, offcourse.

As an exclusive author, you can’t distribute your products through any means but ThemeForest.
However, I think it may be okay if you purchase a license yourself and then give it away. I’ve seen conflicting information on this in the forums. I’d love to hear official word on whether this is acceptable (it seems it should be – a license is a license), but it may be best to contact support directly.
It’s about honesty and ethics.

I was just making a point, that was all. I never said he should do it without Envato’s permission, I was stating a fact

I’d characterize that comment as a suggestive question – with a clear implication – rather than as a “fact”. The point is, rvision clearly isn’t looking to break the rules, as he came here asking advice. Insinuating that breaking a contract is okay if you can get away with it is inappropriate, and I’m guessing that’s why someone reported it.
Enough about that – let’s stay on topic here, please 
rvision, I’d still suggest contacting support for an authoritative answer if a staff member doesn’t end up commenting here (I’d ask specifically about buying a license to give away). And let us know what you find out!

Seven spark said what I wanted to say about that opinion and is not correct because we can find out if website which is using a template is using it legally or not.
In regards to doing charity work. I’m running one charity website, and other one is under construction and for both of them I’m using templates from TF. Giving 35$ for charity is nothing anyway and if you are going to buy yours product than you are losing only less than 50%.

If you’re an exclusive author, you cannot giveaway your items or otherwise sell or distribute them elsewhere. Technically you could do it by purchasing a copy of your own theme on behalf of the organisation and then handing that license over to them so to speak.
