Well, not really sure if it’s mandatory to include icons used in preview, but if icon set has appropriate license than I think there should be no problem. If you are using them in preview it’s also considered as commercial use I suppose, so then you can also include them into download. (if license allows commercial use)

As you have purchased photoshop you have rights to use all tools in your project, but not selling as sepparate icon sets. But that’s how I understand it, maybe someone can tell more about this , i’m also interested
